I'm a contract staff with an employment agency, attached to a renowned manufacturing client. I commenced work on 1st Jan 2008 and this one-year contract was to last till end Dec 2008.
However along the way in October 2008, I discovered I was pregnant. Being honest, I informed both my agency and the company about this pregnancy and edd to be 10th July 2009. In end December 2008, there was a contract review. Despite my pregnancy, the company extended my contract till 1st July 2009.
I seeked advise from my agency on my maternity leave entitlement. The lather then replied in writing, stating that I will be entitled to 16 weeks maternity leave (the agency will bear the costs, if my company is not bearing it) and asked me to update on the start date of my leave. Thereafter, I signed on the new contract indicating my end of employment ie. 1st July 2009.
I was looking forward to my first maternity leave pay recently on end July 2009, but it did not come in. I called up the agency, and they claimed that I am not entitled to it as per the contract I signed. I felt so cheated.
I called MOM for clarifications, and they said that I should be entitled regardless being a contract staff. However it will only be up to 1st July 2009, as I am no longer considered an employee thereafter.
This isn't fair, as that was not what was communicated verbally and in writing to me, by the agency. I specifically asked them back then, and they concluded that I was entitled to 16 weeks. And now, they are not paying.
Any ideas of what I should do??
Did you read through the part on ML entitlement before signing it?
Or do you have any evidence (email etc) to prove what your agent has said?
