    Parties lodging or filing a claim would have to pay claim fees as follows;
    Not exceeding $5,000 Exceeding $5,000 but not exceeding $10,000 Exceeding $10,000 but not exceeding $20,000
    Consumer $10.00 $20.00 1% of claim amount
    Non consumer $50.00 $100.00 3% of claim amount

    Filing a claim - what you need to know
    A person or company who wishes to make the claim is referred to as the "Claimant" while the person or company claimed against is referred to as the "Respondent". The party you claim against can also claim against you in the same claim. This is referred to as a "Counterclaim".

    Claims and Counterclaims can only be filed by the following methods:
    Type Permitted filing method
    Claims - At the Registration counter of the Tribunals; or
    - By Facsimile (Fax)
    Counter claims At the Registration counter of the Tribunals only

    If you are intending to file a claim or counterclaim, please refer to the following tables to find out the appropriate steps you should take.
    Filing a claim

    i. Please note that:

    b. If you had indicated in the Summary of your Claim Form that you are referring to any attached document, please also fax across such copies of the attached documents. If the total number of pages of such supporting documents exceed 3 pages, do not fax the supporting documents. Instead, bring the original(s) and 1 photocopy, and hand it to the Registrar or Assistant Registrar hearing the Consultation;

    c. A clear copy of the latest Instant Information search [Business Profile] of the Respondent, if the Respondent is a business Concern, obtained no earlier than 1 month from the date of filing of the Claim. Please note that the original search is to be tendered at the time of Consultation, to the Registrar or Assistant Registrar;

    d. A clear photocopy of the Instant Information search [Business Profile] if you, as the Claimant, is a business concern;

    e. An authorisation letter on your company’s letterhead, if you are filing on behalf of a Claimant company;

As an indication that the claim will be processed for registration, the Tribunals will send an acknowledgment to parties.     If you are attending at the Tribunals to make payment the following modes of payment are accepted:

    Attending consultation/ mediation
    After a claim is lodged or filed, the Tribunals will fix the claim for a Consultation / Mediation before the Registrar. The Tribunals will generally fix the Consultation / Mediation within 10 or within 14 days from the date of lodging or filing of the claim. If a claim is not settled at the consultation before the Registrar, it will generally be fixed for hearing within 7 or within 10 days from the date of Consultation. For a tourist claim, the Tribunals may fix both the Consultation / Mediation and the Hearing within 24 hours of the lodging or filing of the claim.

    The Tribunals employ mediation extensively in their proceedings. At the Consultation before the Registrar, the Registrar will mediate the claim, to assist parties in resolving the dispute. If the claim is fixed for Hearing before the Referee, the Referee may also explore the possibility of settlement, before adjudicating the claim.

    Even after a claim has been filed, the parties can still attempt to resolve the matter between themselves before the consultation date and should there be a settlement, and if the Claimant wishes to withdraw the claim, the Claimant will have to write in to the Tribunals as regards the withdrawal of the Claim. Parties should also inform the Tribunals, in writing, as regards the settlement.

    After a claim is lodged, the parties are required to first attend a Consultation wherein an attempt for an amicable settlement will be mediated upon by a Registrar or Assistant Registrar of the Small Claims Tribunals. Further consultations can be fixed at the Registrar’s or Assistant Registrar’s discretion, and if no amicable settlement can be arrived at, a hearing date will be given for the parties to attend a Hearing before a Referee. The Referee has the discretion to award costs against a Claimant whose claim is considered by the Referee to be frivolous or vexatious.

    Please note that lawyers are not allowed to represent any party for proceedings at the Tribunals.

      Attending consultation/ mediation
      After a claim is lodged or filed, the Tribunals will fix the claim for a Consultation / Mediation before the Registrar. The Tribunals will generally fix the Consultation / Mediation within 10 or within 14 days from the date of lodging or filing of the claim. If a claim is not settled at the consultation before the Registrar, it will generally be fixed for hearing within 7 or within 10 days from the date of Consultation. For a tourist claim, the Tribunals may fix both the Consultation / Mediation and the Hearing within 24 hours of the lodging or filing of the claim.

      The Tribunals employ mediation extensively in their proceedings. At the Consultation before the Registrar, the Registrar will mediate the claim, to assist parties in resolving the dispute. If the claim is fixed for Hearing before the Referee, the Referee may also explore the possibility of settlement, before adjudicating the claim.

      Even after a claim has been filed, the parties can still attempt to resolve the matter between themselves before the consultation date and should there be a settlement, and if the Claimant wishes to withdraw the claim, the Claimant will have to write in to the Tribunals as regards the withdrawal of the Claim. Parties should also inform the Tribunals, in writing, as regards the settlement.

      After a claim is lodged, the parties are required to first attend a Consultation wherein an attempt for an amicable settlement will be mediated upon by a Registrar or Assistant Registrar of the Small Claims Tribunals. Further consultations can be fixed at the Registrar’s or Assistant Registrar’s discretion, and if no amicable settlement can be arrived at, a hearing date will be given for the parties to attend a Hearing before a Referee. The Referee has the discretion to award costs against a Claimant whose claim is considered by the Referee to be frivolous or vexatious.

      Please note that lawyers are not allowed to represent any party for proceedings at the Tribunals.
