Divorce advice needed

I wud like to get a divorce. We hav been married fr 7 years, one child 3 yrs old. The resale hdb flat we live in is bought by hubs, hes 45. I am a pr, flat does not hav my name.

If i were to file for divorce now, will i be able to fight for the flat?

My concern is i hav no place to stay wth my dd after divorce. If not can we still stay together in different rooms?

Anything advice is appreciated. Thank you!

Sorry to hear that. I'm not a lawyer so I only get feedback from various friends. Best to ask a lawyer friend or call those lawyer agencies for enquiry (some don't need to pay when you making basic enquiries & deciding which lawyer or family services centre).
Separation is 3 yrs unless filed for irreconcilable differences, unreasonable behavior (like abuse etc), infidelity (with proof & admission). If have to stay in same location during this time, there is a term used for the separation - forgot the term - but it can be done.
Technically (i think) his assets under his name is considered matrimonial assets so can fight for half, alimony & maintenance but best negotiated coz costly if it is fought out by lawyers.

mostly likely can claim half of it since you are taking of the children. Anyway, woman has the advantages

Hi jojoki, sorry to hear abt ur story, and unfortunately i also underdgo e same matter as u encounter. Im oso a PR, but luckily he did put my name in when we bot e flat. But nw he keep mention i dun contribute to e hse, i dun pay e hse loan. (coz i staying at home taking care of 2 sml sons and another son stay wz my in law during wkday) so i shall not share e money aft we sell e flat (in fact we bot less than 5 yrs, cant sell yet). I went legal aid bureau b4 enq abt divorce matter, n file it b4. But bcoz of e flat matter (hdb wil get bk e flat if we got to lease it less than 5 yrs we bot) so i decided to cancel e filling, and hv to wait for at least 1 1/2 year. Wat i worried now was my childs custody, i noe for sure i cant get all my kids but even i got either 1 or 2 i also hv problem in raising up them as im not working now. And another problem i encounter was im a PR which was sponsor by him, aft we divorce i will not able to hold my PR status ( which means i loss strong point in fighting childs custody). he refused to sponsor me to bcum citizen as he noe it doesn't benefit him since our relationship getting worse n worse. He keep challenge me to fill for divorce, and if i dun do so i hv to keep endure him. I got no choice, i hv to wait n play e time game with him so tat at least i can sell e flat and can get some money to survive me n my kids in future.
Anyone undergo tis b4, may i ask 1)whether i can get e childs custody since my PR status gonna be terminate aft divorce? 2) can i fill for separation while waiting for another 1 1/2 yrs for e flat to reach 5yrs? 3) how long e process for divorce? I mean frm filling till fully divorce. again e flat matter. We will ask to sell our flat after fully divorce or they will base on e date i file for divorce? If e hdb will back date to e date i file for divorce which means i die die must wait til complete 5yrs then can go for filling. 4) if i get legal bureau's lawyer, wil they able to fight custody n maintenance for me? Or personal lawyer are better in fighting our benefit?
